English summary of “Jews and Homosexuality”

In Greece there is the tendency to see Jews as these strange, dark clad guys with long sideburns ignoring the immense wealth of the Jewish cultural tradition and the amazing variety of the Jewish world. This post is mainly aimed in my greek readers, as to present them with one aspect of contemporary Judaism they are unfamiliar with – Jews and homosexuality. Στην Ελλάδα υπάρχει η τάση να παρουσιάζονται οι εβραίοι ως κάτι φανατικοί με κοτσιδάκια αγνοώντας το τεράστιο πλούτο της εβραϊκής πολιτισμικής παράδοσης και την απίστευτη ποικιλία του εβραϊκού κόσμου. Οπότε ας ασχοληθούμε με ένα θέμα τελείως διαφορετικό…

Εβραίοι και Ομοφυλοφιλία

Ας ξεκινήσουμε με μερικές παραδοχές: η Τορά, (δηλαδή η Παλαιά Διαθήκη κατά τον Χριστιανισμό), μιλάει ξεκάθαρα εναντίον της ομοφυλοφιλίας. Για την ακρίβεια αυτό που καταδικάζει ξεκάθαρα είναι οι ανδρικές ομοφυλοφιλικές σεξουαλικές σχέσεις και το cross dressing, ενώ οι λεσβιακές σχέσεις καταδικάζονται έμμεσα. Ο διαφορετικός σεξουαλικός προσανατολισμός είναι αποδεκτός αρκεί τα άτομα να αποφεύγουν την ίδια την πράξη. Η σημερινός Ιουδαϊσμός μην έχοντας ένα κεντρικό δόγμα, όπως άλλες θρησκείες σαν τον Χριστιανισμό στις διάφορες εκδοχές του, έχει υιοθετήσει διαφορετικές πρακτικές ανάλογα με τα διάφορα ρεύματα μέσα στις τάξεις του.

[Μικρή σημείωση: τα ρεύματα αυτά δεν αποτελούν διαφορετικές θρησκείες μεταξύ τους και ούτε αλληλοχαρακτηρίζονται ως αιρετικοί, με εξαίρεση την μικρή οικογένεια των Σαμαρειτών, όπως συμβαίνει στα διάφορα χριστιανικά δόγματα. Τα κυριότερα ρεύματα είναι ο Ορθόδοξος Ιουδαϊσμός, ο Συντηρητικός Ιουδαϊσμός, ο Μεταρρυθμιστικός Ιουδαϊσμός και ο Αναδομητικός Ιουδαϊσμός.]

Στον Ορθόδοξο Ιουδαϊσμό η ομοφυλοφιλία αποτελεί αμαρτία και ειδικότερα η σοδομία είναι μεταξύ των πιο σημαντικών αμαρτιών. Η πιο ακραίες εκφράσεις του Ορθόδοξου Ιουδαϊσμού βλέπουν την ομοφυλοφιλία ως ανοικτή επανάσταση ενάντια στον Θεό και ειδικότερα το Ισραήλ έχει δει ορισμένες σκληρές αντιπαραθέσεις μεταξύ των ακραίων ορθόδοξων και της mainstream ισραηλινής κοινωνίας η οποία είναι αρκετά εως πολύ φιλική προς την GLBT κοινότητα. Highlight: η κοινή διαμαρτυρία των ηγετών της εβραϊκής, μουσουλμανικής και χριστιανικής κοινότητας στην Ιερουσαλήμ για το Gay Pride το 2000. Αξίζει να σημειωθεί οτι ένας αυξανόμενος αριθμός ορθόδοξων ραβίνων έχουν δηλώσει δημόσια την ομοφυλοφιλία τους.

Στον Συντηρητικό Ιουδαϊσμό η παραδοσιακή πολιτική ήταν αυτή της ανοχής αν και η ομοφυλοφιλία επισήμως καταδικαζόταν και οι θρησκευτικοί γάμοι απαγορεύονταν. Πρόσφατα όμως η Committee on Jewish Law and Standards υιοθέτησε 3 διαφορετικές responsa που επιτρέπουν στους τοπικούς ραβίνους να υιοθετήσουν μια κατά συνείδηση προσέγγιση πάνω στο θέμα της ομοφυλοφιλίας. Πολλές κοινότητες συνεχίζουν να θεωρούν την ομοφυλοφιλία ως απαγορευμένη πράξη, ενώ ορισμένες άλλες πλέον καλωσορίζουν τους ανοικτά gay άνδρες και ανοικτά λεσβίες γυναίκες. Μάλιστα ορισμένα Συντηρητικά ραβινικά σεμινάρια ανακοίνωσαν οτι είναι έτοιμα να δεχθούν τους πρώτους και τις πρώτες gay και λεσβίες ραβίνους, χωρίς αυτό να απαγορεύει να υπάρχουν ήδη Συντηρητικοί ραβίνοι που συζούν με τον σύντροφο τους και έχουν παιδιά.

Η Ραβ.Τοβά Σπίτζερ

Ο Μεταρρυθμιστικός Ιουδαϊσμός, ο οποίος αποτελεί την μεγαλύτερη μερίδα των εβραίων στις ΗΠΑ, έχει αποδεχθεί πλήρως τους ομοφυλόφιλους μεταξύ των μελών του. Ηδη από τα τέλη της δεκαετίας του ‘80 είχαμε τους πρώτους gay ραββίνους και σύντομα μετά τις πρώτες λεσβίες ραβίνους. Οσο αφορά τον γάμο η αρχική θέση ήταν η πλήρη στήριξη υπέρ του πολιτικού γάμου μεταξύ των ομοφυλοφίλων, ενώ σήμερα γίνεται αποδεκτός και ο θρησκευτικός γάμος. Μάλιστα η συμμετοχή του Μεταρρυθμιστικού Εβραϊσμού υπέρ των δικαιωμάτων της GLBT κοινότητας αποτέλεσε ένα από τους πιο σημαντικούς πυλώνες του κινήματος στην δεκαετία του ‘80, ενώ ακόμα και σήμερα πάρα πολλοί εβραίοι ακτιβιστές βρίσκονται στην πρωτοπορία της GLBT κοινότητας, (πχ οι 100 ραβίνοι του Jews for Marriage Equality).

Ο Αναδομητικός Ιουδαϊσμός υπήρξε η πρώτη κοινότητα που αποδέχθηκε ανοικτά την ομοφυλοφιλία από την δεκαετία του ‘70, ενώ ομοφυλόφιλοι είναι δεκτοί στα ραβινικά σεμινάρια ήδη από το 1985. Μάλιστα η σημερινή πρόεδρος του Αναδομητικού Ραβινικού Συμβουλίου είναι η Rav.Toba Spitzer η οποία είναι λεσβία, (στην φωτ0γραφία).

Στης ΗΠΑ: όπως είπαμε η πλειοψηφία του αμερικανικού εβραϊσμού όχι μόνο αποδέχεται την ομοφυλοφιλία, αλλά πολλοί ραβίνοι είναι gay και λεσβίες, ενώ η δέσμευση υπέρ των πλήρων πολιτικών δικαιωμάτων των ομοφυλοφίλων αποτελεί μια ιστορική παράδοση του Αμερικάνικου Εβραϊσμού. Αξίζει να σημειωθεί οτι η πρώτη αποκλειστικά GLBT συναγωγή Μπετ Χαιμ Χαντασιμ ιδρύθηκε το 1972 στο Λος Αντζελες, ενώ η σημερινή μεγαλύτερη GLBT συναγωγή είναι η Μπετ Σιμχά Τορά στην Νέα Υόρκη με 800 οικογένειες ως μέλη. Σήμερα υπάρχουν περίπου 30 συναγωγές που είναι αποκλειστικά gay/lesbian.

Gay Pride στο Τελ Αβίβ

Στο Ισραήλ: το Ισραήλ είναι όπως πάντα μια χώρα των αντιθέσεων. Η κυριαρχία του Ορθόδοξου Ιουδαϊσμό στο Ανώτατο Ραβινικό Συνέδριο της χώρας οδηγεί ώστε η συντριπτική πλειοψηφία του θρησκευτικού χώρου να μην κάνει αποδεκτή την ομοφυλοφιλία και μερίδα του ορθόδοξου πληθυσμού είναι ανοικτά εχθρική. Από την άλλη η ισραηλινή κοινωνία στο σύνολο της αποδέχεται την ομοφυλοφιλία και η Dana International αποτελεί μια παγκόσμια transgender εικόνα . Χαρακτηριστικά αξίζει να αναφερθεί οτι το Ισραήλ μεν δεν αναγνωρίζει τους πολιτικούς γάμους είτε ετεροφυλοφιλικούς, είτε ομοφυλοφιλικούς αν έχουν τελεσθεί στο Ισραήλ αλλά μόνο αν έχουν τελεσθεί στο εξωτερικό. Ετσι μπορεί οι ομοφυλόφιλοι να μην μπορούν να παντρευτούν στο Ισραήλ, αλλά αν το κάνουν σε κάποια άλλη χώρα ο γάμος αναγνωρίζεται κανονικά στο Ισραήλ και επιπλέον επιτρέπεται η υιοθεσία παιδιών. Αξίζει να σημειωθεί το κύμα παλαιστίνιων πολιτικών προσφύγων από την Γάζα και την Δυτ.Οχθη προς το Ισραήλ, αφού η ομοφυλοφιλία σε αυτές τις περιοχές συχνά οδηγεί στην εκτέλεση τους.

Στον κόσμο: δεν υπάρχει συγκεκριμένη τάση και η στάση των τοπικών κοινοτήτων συνήθως ευθυγραμμίζεται με την στάση της τοπικής κοινωνίας. Πχ ενώ στην Αυστραλία γενικώς κυριαρχεί ο Ορθόδοξος Ιουδαϊσμό, τον Ιούλιο είχαμε τον πρώτο θρησκευτικό γάμο λεσβίων στο Σίδνεϊ.

Στην Ελλάδα: δεν έχω ακούσει ποτέ να συζητείται το θέμα – στα πλαίσια της γενικότερης ανεκτικότητας  του Ελληνικού Εβραϊσμού η κυρίαρχη πεποίθηση είναι οτι οφείλουμε να αναγνωρίσουμε τον πολιτικό γάμο αλλά χωρίς να μπορεί να γίνει δεκτή καμιά ομοφυλοφιλική ένωση θρησκευτικά. Οσο αφορά το θέμα της συνεργασίας μεταξύ των κοινοτήτων οφείλω να ομολογήσω την ύπαρξη ενός κλίματος αμοιβαίας δυσπιστίας, αν και η υπόθεση Πλεύρη για πρώτη φορά έφερε ορισμένους εβραίους και ομοφυλόφιλους να συνειδητοποίησουν οτι αυτά που τους ενώνουν είναι περισσότερα από αυτά που τους χωρίζουν.

Πάνω στο συγκεκριμένο θέμα θέλω να προσθέσω οτι δεν είναι μόνο ο εξολοθρευτικά αντισημίτης και ομοφοβικός Πλεύρης που μας ενώνει αλλά και ένα γενικότερο κλίμα υποκρισίας και πατερναλισμού που κυριαρχεί στους “φιλεύθερους” χώρους. Ενδεικτικό αυτού του κλίματος αποτέλεσε η ανακοίνωση της Ελληνικής Ομοφυλοφυλικής Κοινότητας για το indymedia: “πριν από ένα χρόνο κυκλοφόρησε στην γκέι ειδησεογραφία μια απροσδόκητη είδηση. Ενας ομοφυλόφιλος Παλαιστίνιος, έφυγε από την Παλαιστίνη και ζήτησε καταφύγιο στο Ισραήλ. Η ζωή του κινδύνευε από τους φανατικούς μουσουλμάνους και έφυγε για να μην εκτελεστεί…Οι δήθεν προοδευτικοί κι αριστεροί του Athens Indymedia καταξέσχισαν τους συντάκτες της είδησης χρησιμοποιώντας βρωμερούς και μισαλλόδοξους χαρακτηρισμούς. Ο Παλαιστίνιος γκέι έγινε “προδότης του λαού του που νοιαζόταν μόνο για τον κώλο του” κι όσοι μιλούσαν για το δικαίωμα των ομοφυλόφιλων να ζήσουν, ονομάζονταν “πράκτορες της Μοσάντ και της CIA”.

Συνοψίζοντας: ενώ αναμφίβολα η εβραϊκή καταγωγή του οδήγησε τον Χριστιανισμό να απορρίπτει την ομοφυλοφιλία, ο μοντέρνος Ιουδαϊσμός έχει  υιοθετήσει μια τελείως διαφορετική στάση και στην πλειοψηφία του, (με την μεγάλη εξαίρεση του Ορθόδοξου Ιουδαϊσμού), έχει ενσωματώσει την GLBT κοινότητα στην θρησκευτική και κοινοτική ζωή χωρίς αυτό να σημαίνει οτι δεν υπάρχουν και κρούσματα ομοφοβίας σε ευθεία συνάρτηση με το γενικότερο κλίμα της κοινωνίας. Επιπλέον η εβραϊκή παράδοση έχει υπάρξει παραδοσιακά φιλελεύθερη και είναι στο χέρι όλων μας να παραμείνει τέτοια – άλλωστε ας μην ξεχνάμε οτι οι ίδιοι άνθρωποι που πετούν το “πούστης” ως βρισιά, πετούν μαζί και το “εβραίος”, όπως είδαμε στην περίπτωση των οπαδών του ΠΑΟΚ.

Trivia:

• από τους πιο γνωστούς ανοικτά ομοφυλόφυλους εβραίους να αναφέρω τον δολοφονημένο πολιτικό Χάρβευ Μιλκ, τον τραγουδιστή Λου Ριντ, τον σχεδιαστή Μαρκ Τζεικομπς και την Αρχιραβίνο Τοβά Σπίτζερ που ηγείται του Αναδομητικού Ιουδαϊσμού και είναι λεσβία.
• Κατά την διάρκεια της έρευνας μου συγκινήθηκα διαβάζοντας την ιστορία των Σέφερ Τορά, (χειρόγραφων παπύρων της Τορά που διαβάζονται στην συναγωγή), της LBGT συναγωγής Μπετ Μισπαχά, (Σπίτι της Οικογένειας στα εβραϊκά). Ο πρώτος πάπυρος υπήρξε ένα μόνιμο δάνειο μιας συναγωγής του Λονδίνου το 1979 και αρχικά ανήκε στην κοινότητα Ντόλνι Κούνιτσε στην Τσεχοσλοβακία και η οποία εξοντώθηκε στο Ολοκαύτωμα. Ο τελευταίος της πάπυρος έχει ένα ουράνιο τόξο και γράφει στο διακοσμητικό του κάλυμμα ένα κομμάτι της Τορά: Και όταν δω το ουράνιο τόξο θα θυμηθώ την Διαθήκη μου.

A small piece of news which I found of great importance, (via φιλευθερος and roides):

Greece is the only country in the European Union that allows the implementation of the Sharia, the muslim religious law. This is based on the 1923 Treaty of Lausanne governing the status of the muslim minority of Western Thrace or rather a convenient, (for various reasons both for the Greek State and the Muslim Minority), interpretation of the Treaty. Still recently the Court of First Instance, (Πρωτοδικείο), of Rodopi has overturned a decision by an islamic court stating that :

“the prerogatives of the mufti (…) cannot act towards the direction of violating the personal/civil rights of muslim women“

The case regarded the inheritance that was to be assigned to a daughter and was half of what the son would perceive. It is the first of it’s kind and opens up the way to the abolition of the practice since it directly challenges the decision of the mufti. You can read an article on the greek Sharia by Ios but I’d also recommend reading an interesting dialogue at e-roosters.

With the founding of modern Greece in 1821 the State refrained from issuing specific laws regarding the Jewish Religious Law, (the sum of all jewish law, written and oral, collectively known as Halakha), mainly because the number of jews living in the Kingdom was so small. In practice, internal family affairs were regulated by Jewish Law and the jews lived in a relative autonomy. This situation changed in 1912 when the huge Community of Salonica and smaller others in Epirus, Macedonia and Thrace were incorporated into the Greek State. The need to regulate the Community of Thessaloniki which operated in all spheres of life, combined with the special political conditions of the era led to the Law 2456 of 1920 which is still valid today with small but important modifications.

Τhe Law 2456/1920 governs the functioning of Jewish Communities in Greece and allowed space for Jewish Law on matters pertaining specific cases of Family Law. These included marriage, divorce, alimony and restoration of the dowry in case of a divorce; eventual tutelage of children and similar matters were relegated to the greek Civil Law. Of course there were some distinct phases in the implementation and Beith Dins, (i.e. the rabbinical courts), never really caught on, since the majority of the cases needed the civil courts. In any case the special provisions for jewish religious law were abolished with the introduction of the new Civil Code in 1946 – this meaning that Jewish Religious Law today has no valence in Greece for either jewish greeks or jews of foreign nationality.

Though the Beith Din’s are not officially abolished I have not ever heard of rabbinical courts after 1949; though I’m sure that if there is a opportunity for any Jewish Community to form a committee then -by God- she shall form it! Still, even if one was convoked, the Beith Din would have to limit itself to the matters of granting spiritual dissolution of the marriage (get), and lifting of the husband’s brother’s authority over the wife (halitsa), i.e. strictly spiritual matters. There are some legal questions on whether greek civil courts are held to honor religious law but established practice and the lack of will of the jewish greeks has led to a de facto and contemporary de jure, abolition of religious law.

Personally I think that this is a good thing and despite the personal beliefs of each citizen, it should be clear that we all live in a secular State; the Law, based on the Constitution, is sovereign and religion is not allowed to act as a harness of Civil Rights.

Still there are some regards on the extent we accept multiculturalism and thus we accept ethical values different from ours; should we post limits as to what a secular State can accept, (eg is polygamy allowed? Dowry?). This is a big subject but I feel it addresses more the issues raised by the post-90’s immigration and not the Jewish Community which has waived this prerogative a long time ago and has integrated itself fully to the Institutions of the modern Greek State. Still it’s an interesting subject which often longs for answers not simple to give.

PS. Personally I’d also favor a mix of the current religious laws which would allow me to have more than one muslim wives, keep my jewish wife from touching anyone unless it’s a relative and have my christian wife to declare to obey me for ever. I believe that such a development would meet the appraisal of at least 50% of the greeks and act as a major pillar to Ecumenism. Don’t you agree? :)

Here’s a campaign against a proposed bill in Greece that institutes a domestic partnership contract but reserves it for heterosexual couples only. I fully acknowledge it’s truth and wholeheartedly support it – as it says civil rights for all!

Στην Ελλάδα οι γκέι, οι λεσβίες και οι τρανσέξουαλ γνωρίζουν από διακρίσεις. Τις αντιμετωπίζουν καθημερινά στην οικογένεια, την κοινωνική ζωή και τον επαγγελματικό στίβο.Καμιά φορά όμως φτάνει μια σταγόνα για να ξεχειλίσει το ποτήρι.Σύμφωνα με δημοσιεύματα του τύπου το Υπουργείο Δικαιοσύνης ετοιμάζεται να καθιερώσει ένα “συμβόλαιο συμβίωσης” ΑΠΟΚΛΕΙΣΤΙΚΑ για τα ετερόφυλα ζευγάρια. Δεν θεωρούμε ότι ένα απλό “συμβόλαιο” μπορεί να λύσει τα ζητήματα των ζευγαριών ίδιου φύλου, ούτε να εξασφαλίσει την ισότιμη μεταχείρισή τους. Πιστεύουμε όμως ότι η προτεινόμενη διάκριση είναι κατάφωρα αντίθετη τόσο με το ελληνικό Σύνταγμα όσο και με τις ευρωπαϊκές συνθήκες για τα δικαιώματα του ανθρώπου. Πόσο μάλλον όταν 18 ευρωπαϊκές χώρες ήδη παρέχουν νομική κατοχύρωση στα ζευγάρια ίδιου φύλου.Σκοπός αυτής της πρωτοβουλίας είναι να ενημερωθούν σχετικά οι ευρωπαϊκοί θεσμοί, οι οργανώσεις για τα ανθρώπινα δικαιώματα, ιστοσελίδες και ιστολόγια σε όλο τον κόσμο. Αυτό που ζητάμε είναι ίσα δικαιώματα για όλους. Τίποτα παραπάνω, τίποτα λιγότερο.Αυτή τη φορά δεν θα μείνουμε σιωπηλοί. They face it daily from their families, in their social lives and in the professional field.But sometimes, all it takes is a single straw to break the camel’s back.According to press reports, the greek government is preparing to introduce a domestic partnership “contract” EXCLUSIVELY for unmarried heterosexual couples. We do not believe that a mere “contract” can resolve the issues same-sex couples face or ensure their fair treatment under the law. However this discriminatory proposal is a direct contravention of the greek Constitution, as well as european human rights treaties. Especially since same-sex couples already enjoy legal rights in 18 european nations.The aim of this intervention is to make sure that european institutions, human rights organizations, websites and weblogs from around the world learn about these proposals. What we ask for is equal rights for all. Nothing more and nothing less.This time around we will not sit idly by. This time around we will not keep silent.

A couple days ago I read on the site of the Greek Helsinki Monitor, a NGO on Human Rights, of a piece of news which I must admit didn’t displease me at all! The European Court of Human Rights, (whose jurisdiction is acknowledged by Greece), convicted the Greek Goverment on it’s insistence on forcing people to take a religious oath inside the courtrooms.

On the specific case of Alexandrides vs Greece, a lawyer was forced to declare himself not a Christian Orthodox but an atheist. The ECHR didn’t think that it was a good idea…

“The Court held that the fact that the applicant had had to reveal to the court that he was not an Orthodox Christian had interfered with his freedom not to have to manifest his religious beliefs. There had therefore been a violation of Article 9.”

There are two reasons that I find this decision to be a great thing for me as a jewish greek:

• The privacy issue. I don’t feel comfortable on giving up private data to anyone, the same way I don’t like that anyone should know what soccer team do I support or what political party do I vote for. Why? Cause it’s simply nobody’s business.

• The second, and much more important on the practical side, is the discrimination issue. Some might argue that it is unjust to treat judges beforehand as possible antisemites who will abjure their oath and discriminate against you as soon as they’ll find out you’re not a christian orthodox.

  I’d agree on a purely theoretical level but since we live on the Real World(TM) I’d prefer not taking any chances. This holds especially true since it is fairly recent the discovery of an extrajudicial circuit which aimed to produce pre-arranged court decisions and in which some Greek Church officials played a major role and as we know there isn’t much sympathy towards jews in such circles. Also it doesn’t help out that in the recent neo-nazi Plevris trial some court members were blatantly hostile and pro-nazi and disgraced the Greek Justice system. This does not mean that the greek justice system is fundamentally flawed. But it is comprised of humans and in my opinion it is evident that the respect of civil rights in Greece is not a priority of the greek judges; this no less and no more than it is for the rest of the greek society.

Or to put it in simpler words: My experience with the public sector in Greece is that the conduct of civil servants all too frequently changed when their eye fell of the “israelite”on my ID card. I have no reason to believe that the greek Justice should be any different, especially given it’s not too enviable history on civil rights matters. So even though I’d prefer that I wouldn’t have to worry about the disclosure of  my religious beliefs, I also would like to conduct a normal life without such worries.

In any case let’s hope that our Government will move soon to abolish religious oath not only in courts but also in the Army and in the Greek Parliament. Last but not least I’d like give my compliments to Mr. Theodoros Alexandrides who showed courage and succeeded in bringing home a great decision!
